Understanding Last Will and Testament

When it comes to estate planning, it’s easy to mix up a last will and testament with a living trust. While both help manage what happens to your assets after you pass, they play very different roles.

A last will and testament gives you the power to:

  • Decide who inherits your property

  • Choose a personal representative to carry out your wishes

This document only takes effect after your death and must go through probate court. That means your personal representative can’t begin distributing your assets until they are officially appointed by the court and receive certified letters of testamentary.

Wills

Although this document does not mitigate probate, it is one of the primary documents filed with the court when opening Probate, and will be used to have the court appoint your personal representative to distribute assets of the estate.

Information About Your Children

  • Full names

  • Birthdates

  • Cities and states of residence

Successor Trustee Details

  • Name, date of birth, and location (city & state)

  • Also include the same details for an alternate successor trustee—a backup, just in case

Asset Documentation

  • Copies of real estate deeds

  • Names of financial institutions and account numbers

  • Details on any vehicles valued over $75,000 (make, model, and year)

Medical Directives

  • A completed Living Will

  • A Healthcare Power of Attorney
